Bankruptcy

The Attorneys at PM LAW assist clients with filing bankruptcy under either Chapter 7 or Chapter 13 of the United States Bankruptcy Code.  We evaluate a client’s financial situation and determine the type of relief available.

Chapter 7 (Liquidation)

Chapter 7 is designed for debtors whose debts are primarily consumer debts.  Debtors must pass an income “means test” to determine eligibility of a chapter 7 filing.  The purpose of filing a Chapter 7 is to obtain a discharge of existing debts.

Chapter 13 (Repayment)

Chapter 13 is designed for individuals with regular income and who do not pass the income “means test” and who can pay all or part their debts in installments over a period of time, usually 3 or 5 years.  A debtor must file with the court a plan to repay creditors with future earnings.  After completing payments pursuant to the plan, the debtor receives a discharge.
